TUESDAY, DECEMBER 2, 2014

Meeting called to order at 11:05 AM. Present: President Gagliardi, Recording Vice President O’Connor, Executive Board members Brandford, Cutler, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Bond.

Minutes from November 25, 2014 reviewed. It was moved and seconded to approve the minutes from November 25, 2014 as corrected. Motion carried unanimously.

President Gagliardi reported on how changes in the Musicians Health Fund affect Local 802 employees covered under Local 802’s collective bargaining agreement with the Office and Professional Employees International Union, Local 153. Discussion held.

Executive Board member Cranshaw present at 11:18. Gagliardi reported on Musicians Health Fund matters. Discussion held.

Discussion held on New York City Ballet Orchestra issues.

Gagliardi reported on Metropolitan Opera Orchestra matters. Discussion held.

Recording Vice President O’Connor reported on a meeting the Local 802 officers attended with Brooklyn Borough President Eric Adams on November 27. Discussion held.

O’Connor reported on an organizing training for Local 802 business reps and organizers to be held on December 4. Discussion held.

Local 802 Controller Camiolo present. Camiolo presented September financials. Discussion held. Camiolo excused.

Concert Representative Fisher present. Fisher presented a request from the Bronx Arts Ensemble to use public service scales for the following: one rehearsal on December 5 and one concert on December 6, two concerts on December 13 and 14 respectively, an additional concert on December 6 and a concert on December 7. Discussion held. Fisher excused. It was moved and seconded to grant the request. Motion carried unanimously.

TUESDAY, DECEMBER 9, 2014

Meeting called to order at 11:12 a.m. Present: President Gagliardi, Financial Vice President Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Burridge, Cutler, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Bond.

AFM President Ray Hair and Assistant to the AFM President Ken Shirk present. President Hair reported on AFM matters, including Integrated Media Agreement negotiations, the Federation Internationale des Musiciens (FIM) conference in Budapest, and logistic planning for the 2016 AFM convention. Discussion held. Hair and Shirk excused.

Minutes from December 2, 2014 reviewed. It was moved and seconded to approve the minutes from December 2, 2014 as corrected. Motion carried unanimously.

President Gagliardi reported on the New York City Ballet ratification process. Discussion held.

Gagliardi reported on a grievance settlement with the Broadway League over “Sideshow” issues. Discussion held.

Gagliardi reported on health and safety issues at “Les Miserables.” Discussion held.

Gagliardi reported on discussions with Office and Professional Employee International Union Local 153 on the health insurance benefits clauses in their collective bargaining agreement with Local 802. Discussion held.

Gagliardi reported on the New York City Opera bankruptcy and related matters. Discussion held.

Recording Vice President O’Connor reported on Resorts World Casino organizing. Discussion held.

O’Connor presented a request for a donation to the Hudson River Sloop Clearwater. It was moved and seconded to donate $250 to the Hudson River Sloop Clearwater. Discussion held. Motion carried unanimously.

Theater Representative Blum present. Blum presented a memorandum of agreement (MOA) with Happy Tune Productions for the production of “Disenchanted.” Discussion held. Blum excused. It was moved and seconded to approve the MOA with Happy Tune Productions.

Assistant to the President Bond presented the renewed Off Broadway Area Standards Agreement. Discussion held.

Concert Representative Fisher present. Fisher presented a request from Knickerbocker Chamber Orchestra to use public service scales for educational concerts on the following dates: January 14, 15, 20, 21, 22, 23 and 29. Discussion held.

Olcott presented an MOA with the New Jersey Festival Orchestra (NJFO). Discussion held.

Executive Board member Brandford excused at 1:19. Fisher excused. It was moved and seconded to approve the request from Knickerbocker Chamber Orchestra. Motion carried unanimously. It was moved and seconded to approve the MOA with NJFO. Motion carried unanimously.

O’Connor presented a MOA with the Apollo Theater Foundation, Inc. Discussion held. It was moved and seconded to approve the MOA with the Apollo Theater Foundation. Motion carried unanimously.

O’Connor presented 3 requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Executive Board member and Emergency Relief Fund (ERF) fundraiser Schwartz reported on ERF fundraising. Discussion held.

President Gagliardi reported on negotiations with the Metropolitan Opera. Discussion held.

Gagliardi reported on negotiations with City Center for “City Center Encores!,” “City Center Off Center” and “The Lobby Project.” Discussion held.

Gagliardi reported on Actors Federal Credit Union matters. Discussion held.

Local 802 Trial Board vacancy discussed. Executive Board member Brandford present at 11:28. It was moved and seconded to appoint Bruce Eidem to the Trial Board. Motion carried. Dougherty and Kruvand opposed.

Gagliardi reported on a tentative agreement reached with 54 Below. Discussion held.

Local 802 building issues discussed.

Former President Bill Moriarity present on speaker phone. Moriarity gave a report on changes in pension rules tied to a spending bill recently passed by the U.S. Congress. Discussion held. Executive Board member Brandford excused at 12:40. Call with Moriarity ended.

Financial Vice President Olcott presented a request from the Long Island Philharmonic to use public service rates for concerts on December 16, January 21, March 25 and April 16. It was moved and seconded to grant the request. Motion carried unanimously.

Recording Vice President O’Connor reported on Resorts World Casino organizing. Discussion held.

O’Connor reported on a phone meeting with Jazz at Lincoln Center’s executive director. Discussion held.

O’Connor reported on BuskNY, an advocacy organization for musicians playing in the New York City subway system. It was moved and seconded to endorse the BuskNY campaign to pass a City Council resolution recognizing September 2015 as the 30th anniversary of legal artistic performance in the New York City subway, and calling on the NYPD and MTA to take steps to end wrongful ejection, ticketing, and arrest of subway performers. Discussion held. Motion carried unanimously.

Gagliardi reported on Radio City’s “New York Spring Spectacular.” Discussion held.

Gagliardi presented a memorandum of agreement (MOA) with the Metropolitan Opera for associate and extra musicians employed by the Metropolitan Opera. Discussion held. It was moved and seconded to approve the MOA. Motion carried unanimously.

Gagliardi presented an MOA with the Metropolitan Opera for staff musicians employed by the Metropolitan Opera. It was moved and seconded to approve the MOA. Motion carried unanimously.

Theater Representative Couture present. Discussion continued on Radio City’s New York Spring Spectacular. Couture and Assistant to the President Bond excused.

O’Connor presented two requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Minutes from December 16, 2014 reviewed. It was moved and seconded to approve the minutes from December 16, 2014 as corrected. Motion carried unanimously.

Recording Vice President O’Connor reported on the Temptations and the Four Tops, a limited engagement at the Palace Theater. Discussion held.

Financial Vice President Olcott presented a request from the Bronx Arts Ensemble to use public service scales for an educational concert on December 22. Discussion held. It was moved and seconded to grant the request. Motion carried unanimously.

Olcott reported on the Little Orchestra Society contract.

Olcott reported on Orpheus Chamber Orchestra health insurance matters. Discussion held.

O’Connor reported on Local 802 organizing goals with respect to casinos in New York State.

O’Connor reported on an organizing database program the Organizing Department is putting into place. Discussion held.

Local 802 Theater Representative Couture present. Couture presented an agreement with the Vivian Beaumont Theater for the production of “The King and I.” Discussion held. Discussion held on the Four Tops and the Temptations appearance at the Palace Theater. Couture excused.

It was moved and seconded to approve the agreement with the Vivian Beaumont Theater for “The King and I.” Motion carried unanimously.

Local 802 Organizer Gasteyer present. Gasteyer presented a collective bargaining agreement (CBA) with BOOM Collective for the Winter Jazz Festival. Discussion held. Gasteyer excused. It was moved and seconded to approve the CBA with BOOM Collective. Motion carried unanimously.

Electronic Media Services Department Representative Sheldon present. Sheldon presented a request from Theresa Wozunk to use the Broadway Limited Pressing Agreement for “Liberty.” Discussion held. Sheldon excused. It was moved and seconded to grant the request for the use of the Broadway Limited Pressing Agreement for “Liberty.” Motion carried unanimously.

O’Connor presented a CBA with 54 Below. Discussion held. President Gagliardi present on speaker phone. It was moved and seconded to approve the CBA with 54 Below. Motion carried unanimously.

Further discussion held on the Four Tops and the Temptations appearance at the Palace Theater. Conference call with Gagliardi ended.

O’Connor presented 4 requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

TUESDAY, JANUARY 6, 2015

Meeting called to order at 11:10 a.m. by Financial Vice President Olcott. Present: Olcott, Recording Vice President O’Connor, Executive Board members Burridge, Cranshaw, Cutler, Dougherty, Hyde, Kruvand, Schwartz, Sharman, Assistant to the President Bond.

Minutes from December 23, 2014 reviewed. It was moved and seconded to approve the minutes from December 23, 2014 as corrected. Motion carried unanimously.

Assistant to the President Bond presented a request from President Gagliardi to approve a one class upgrade for his travel to Theatrical Motion Picture Agreement negotiations and AFM-EPF meetings in Los Angeles, cost to be shared by the AFM. Discussion held. It was moved and seconded to grant the request. Motion carried unanimously.

Financial Vice President Olcott requested annual salary adjustments for 3 Local 802 non-bargaining unit employees.It was moved and seconded to approve the adjustments. Motion carried unanimously.

Olcott reported on the status of Westchester Philharmonic back wages and benefits owed for services of Local 802 members. Discussion held.

Recording Vice President O’Connor presented a request for a donation to Labor Notes, a non-profit independent labor journal that reports on the national labor movement. Discussion held. It was moved and seconded to donate $250 to Labor Notes. Motion carried unanimously.

O’Connor reported on Local 802 organizing goals for 2015. Discussion held.

O’Connor reported on plans for a French production company to record sets at the Winter Jazz Festival for French television broadcast. Discussion held. President Gagliardi present at 12:20. Gagliardi assumed the chair. Discussion on recording at the Winter Jazz Festival continued.

O’Connor presented 2 requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.
