TUESDAY, NOVEMBER 10, 2015

Meeting called to order at 11:08 a.m. by Financial Vice President Olcott. Present: Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Cutler, Cranshaw, Dougherty, Kruvand, Schwartz. Minutes from October 27, 2015 reviewed. It was moved and seconded to approve the minutes from October 27, 2015 as corrected. Motion carried unanimously.

Financial Vice President Olcott reported on Westchester Philharmonic matters. Olcott reported on New York Pops matters. Discussion held.

Recording Vice President O’Connor reported on Local 802 Emergency Relief Fund matters. Discussion held. O’Connor reported on First Choice Musicians and Council for Living Music business. Discussion held. O’Connor reported on the Joe Hill Centennial Health Fair on November 18 in Tompkins Square. Discussion held. It was moved and seconded to endorse the Joe Hill Centennial Health Fair. Motion carried unanimously.

Executive Board member Hyde and Assistant to the President Bond present at 11:42. O’Connor presented a Collective Bargaining Agreement (CBA) with New York Jazzharmonic, Inc. Discussion held. It was moved and seconded to approve the CBA with New York Jazzharmonic, Inc. subject to ratification by the bargaining unit. Motion carried unanimously.

Olcott reported on various educational outreach efforts to area music institutes and schools.

Assistant to the President Bond reported on health and safety matters on Broadway. Discussion held. Bond excused.

Local 802 Controller Camiolo present. Camiolo presented August financials. Discussion held. Camiolo excused.

Proposed amendments to the New York City Central Labor Council bylaws discussed.

O’Connor reported on Lincoln Center American Songbook matters. Discussion held.

O’Connor presented a request for a donation to the Greater New York Labor-Religion Coalition. Discussion held. It was moved and seconded to donate $250 to the Greater New York Labor-Religion Coalition. Motion carried unanimously.

O’Connor reported on an organizing database program being developed to strengthen Local 802’s organizing capabilities. Discussion held.

Local 802 Business Rep Friedman present. Friedman presented a collective bargaining agreement (CBA) with Big Apple Circus. Discussion held. Friedman excused. It was moved and seconded to approve the CBA with Big Apple Circus. Motion carried unanimously.

Executive Board Brandford member excused at 1:12. Local 802 Concert Representative Fisher present. Fisher presented a memorandum of agreement with The Sacred Music Society of Our Lady Queen of Martyrs Church and Oratorio Society of Queens. Discussion held. Fisher excused. It was moved and seconded to approve the MOA with The Sacred Music Society of Our Lady Queen of Martyrs Church and Oratorio Society of Queens subject to ratification.

O’Connor presented nine requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Local 802 Theatre Representative Blum present. Blum presented a Commercial Off Broadway Area Standards Agreement with Tappin NY for the production of “Tapping through Life.” Discussion held. Blum presented a Theatrical Musicians Agreement (TMA) with the Classical Theatre of Harlem for the production of “The First Noel.” Discussion held. Blum excused. It was moved and seconded to approve the TMA with the Classical Theatre of Harlem. Discussion held. Motion carried unanimously. It was moved and seconded to approve of the agreement with Tappin NY. Motion carried unanimously.

TUESDAY, NOVEMBER 17, 2015

Meeting called to order at 11:07 a.m. by Financial Vice President Olcott. Present: Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Burridge, Cutler, Cranshaw, Dougherty, Kruvand, Schwartz, Sharman, Assistant to the President Bond. Minutes from November 10, 2015 reviewed. It was moved and seconded to approve the minutes from November 10, 2015 as corrected. Motion carried unanimously.

Financial Vice President Olcott reported on Local 802’s annual liability insurance bill of $26,189.68. Discussion held.

Olcott requested annual salary adjustments and a merit increase for a Local 802 non-bargaining unit employee. It was moved and seconded to approve the increase. Motion carried unanimously. Financial Vice President Olcott presented a list of proposed recipients of holiday bonuses. Discussion held.

Recording Vice President O’Connor presented an invitation to the Metro New York Health Care for All annual gala benefit on November 24. It was moved and seconded to purchase a quarter page ad and two tickets to the gala for $250, to be paid from the public relations budget. Motion carried unanimously.

Local 802 Building Manager Little present. Little reported on necessary elevator repairs. Discussion held. Little excused. It was moved and seconded to spend $4,050 on necessary elevator repairs. Motion carried unanimously. It was moved and seconded to raise the holiday bonus amount to each fulltime Local 802 employee by $30. Discussion held. Motion carried unanimously.

Executive Board member Hyde present at 11:43. Electronic Media Services Department Representative Sheldon present. Sheldon presented a limited pressing agreement (LPA) with Little Pumpkin Records, LLC for the production of “Music From Grace.” Discussion held. Sheldon excused. It was moved to approve the LPA with Little Pumpkin Records.

O’Connor reported on New School For Jazz and Contemporary Music negotiations. Discussion held. O’Connor reported on Avatar negotiations. O’Connor reported on Jazz at Lincoln Center negotiations. Discussion held. O’Connor reported on Lincoln Center American Songbook. Discussion held. It was moved and seconded to instruct members to refrain from taking work with any artist, act or contractor booked into the 2016 season of American Songbook until an agreement is reached with Lincoln Center with regard to American Songbook and Lincoln Center Out of Doors. Discussion held. Motion carried. Kruvand opposed.

Board recessed at 12:40. Board reconvened at 12:48. Local 802 Organizer Gasteyer present. Gasteyer reported on a concert being presented at BAM that is under a Local 802 union agreement. Discussion held. Gasteyer excused.

Executive Board member Schwartz reported on his attendance at Music Cities and the Future of Music Summit. Executive Board member Brandford excused at 1:10. Executive Board member Dougherty reported on matters having to do with court proceedings regarding the homicide of Local 802 member Mary Whitaker. Discussion held.

O’Connor requested a donation of $500 to the Jazz Foundation of America. It was moved and seconded to make the donation. Discussion held. Motion carried unanimously.

O’Connor presented two requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Financial Vice President Olcott reported on New Jersey Festival Orchestra matters. Discussion held. Olcott presented a proposed increase in the Local 802 public service scales. It was moved and seconded to raise the public service scales by 2 percent, effective January 1, 2016. Discussion held. President Gagliardi present at 11:29. Gagliardi assumed the chair. Motion carried unanimously.

Gagliardi reported on Organization of Union Representatives negotiations. Discussion held.

Gagliardi reported on a letter received from International Alliance of Theatre Stage Employees (IATSE) Local 1 announcing an agreement with the Broadway League. Discussion held.

Gagliardi reported on Metropolitan Opera Orchestra matters. Discussion held. Gagliardi reported on New York Philharmonic matters. Discussion held.

Recording Vice President O’Connor reported on Avatar Studio staff negotiations. Discussion held. 54 Below matters discussed.

O’Connor presented to the Executive Board charges brought by a Local 802 member against another Local 802 member. It was moved and seconded to refer the charges to the Trial Board. Discussion held. Motion carried unanimously.

O’Connor presented four requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously. O’Connor reported on Local 802 Emergency Relief Fund matters.Discussion held.

President Gagliardi absent on union business. Minutes from November 24, 2015 reviewed. It was moved and seconded to approve the minutes from November 24, 2015 as corrected. Motion carried unanimously.

Financial Vice President Olcott reported on New York Pops orchestra matters. President Gagliardi present at 11:15 a.m. Olcott reported on matters pertaining to the rental of space on the 4th floor currently occupied by the Actors Federal Credit Union.

Gagliardi presented a Side Letter Agreement to the Met Opera Collective Bargaining Agreement pertaining to concert attire during and after the New York season. It was moved and seconded to approve the Side Letter Agreement, subject to ratification by the bargaining unit. Discussion held. Motion carried unanimously. Gagliardi presented a Letter of Understanding between Local 802 and the Metropolitan Opera pertaining to chamber music concerts at Carnegie Hall presented by Phramus, Inc., subject to ratification by the bargaining unit. It was moved and seconded to approve the Letter of Understanding. Discussion held. Motion carried unanimously.

Gagliardi reported on Organization of Union Representatives (OUR) negotiations. Discussion held. Gagliardi presented two requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Local 802 counsel Harvey Mars present. Gagliardi reported that a secret ballot was cast by a member in good standing in favor of the unopposed slate of candidates for Local 802 office.

Mars reported on OUR negotiations. Discussion held.

Discussion held on issues of smoke and fog in Broadway theatres.

Executive Board member Schwartz reported on multiple Broadway cast performances on The Learning Channel’s live cable television broadcast of “Broadway at the White House” that aired on November 26, 2015. Discussion held.

TUESDAY, DECEMBER 8, 2015

Meeting called to order at 11:09 a.m. by Financial Vice President Olcott. Present: Olcott, Executive Board members Brandford, Cranshaw, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Bond. President Gagliardi absent on union business. Minutes from December 1, 2015 reviewed. It was moved and seconded to approve the minutes from December 1, 2015 as submitted. Motion carried unanimously.

Assistant to the President Bond presented a request from New York City Opera Renaissance to pay for a second rehearsal on the evening of January 17 at day rates. Discussion held. It was moved and seconded to grant the request. Motion carried unanimously.

Financial Vice President Olcott requested $11,720 to pay for the printing of the Local 802 Membership Directory. Discussion held. It was moved and seconded to pay for the printing. Motion carried unanimously. Discussion held on electronic availability of the membership directory.

Olcott reported on New Jersey Festival Orchestra matters. Olcott presented a letter from the AFM International Executive Board on a decision regarding work dues on New Jersey Festival Orchestra performances. Discussion held. Olcott reported on New York Pops negotiations.

Recording Vice President O’Connor presented a request from Inside Broadway to purchase tickets to their Theatre Party on December 3. Discussion held. Local 802 Administrative Assistant Covo present. Discussion held. Covo excused. It was moved and seconded to purchase two tickets to the Theatre Party showing of “On Your Feet” for a total of $300. Motion carried unanimously. O’Connor presented a request from the Workman’s Circle for a donation. Discussion held. It was moved and seconded to donate $100 to the Workman’s Circle. Motion carried unanimously.

O’Connor reported on discussions with Lincoln Center management regarding the American Songbook and Lincoln Center Out of Doors series. Discussion held. O’Connor reported on the upcoming expiration of the collective bargaining agreement with 54 Below.

O’Connor reported on two amendments to the Local 802 Bylaws submitted by the Recording Vice President to be considered at the February Local 802 Membership meeting. Discussion held. It was moved and seconded that the Executive Board report the Bylaw amendments favorably. Motion carried unanimously.

Executive Board member Dougherty excused at 12:40. Local 802 Concert Representative Fisher present. Fisher presented requests from North/South Consonance, Inc. to use public service scales for the following free rehearsals and concerts: January 7, 8 and 9 for 14 musicians; February 11, 12 and 14 for 16 musicians; February 27 and 28 for two musicians; March 14 and 15 for seven musicians. Discussion held. Fisher excused. It was moved and seconded to grant the requests. Motion carried unanimously.

Financial Vice President Olcott reported on American Symphony Orchestra matters. Olcott presented a memorandum of agreement (MOA) with the New York Pops Orchestra. Discussion held. It was moved and seconded to approve the MOA, pending correction and clarification by Financial Vice President Olcott of Article 11, Paragraph D – “Excused Performance”, correction to be approved by email vote of the Executive Board. Discussion held. Motion carried unanimously. Olcott reported on Orchestra of St. Luke’s negotiations. Olcott reported on the live music for dance initiative. Discussion held.

Recording Vice President O’Connor reported on a discussion with Lincoln Center management regarding American Songbook and Lincoln Center Out of Doors. Discussion held. O’Connor reported on Avatar negotiations. O’Connor reported on a possible settlement of a suit by the AFM against Kidam to recover wages and benefits from the taping of musicians at the 2015 Winter Jazz Festival. Discussion held. O’Connor reported on the hiring of an Assistant Building Manager. Discussion held.

Jazz Representative Weeks present. Weeks presented a collective bargaining agreement (CBA) with Jay-Oh Productions, Inc. Discussion held. Weeks presented a CBA with Jack Kleinsinger for the Highlights in Jazz series. Discussion held. Weeks reported on the upcoming Jazz Connect Conference in January. Discussion held. Weeks excused.
