New York University and Vice Dean Ted Magder have been placed on the AFM International Unfair List due to their unwillingness to cover Local 802 musicians under any agreement. NYU employs Local 802 members as independent contractors in its film scoring workshops as well as in theatrical engagements and other work. Local 802 members should not work at New York University, including recording engagements, theatrical work, or any other kind of performance or recording work. (NOTE: This does not include the duties that Local 802 members may have as NYU faculty.) Musicians should notify us if they are called for any work at NYU. According to Article IX, Subdivision #1, Section C of the Local 802 bylaws: “Members shall not accept or play any engagement in the jurisdiction of the Union except pursuant to a contract approved and accepted by the Union. A member who violates this provision shall be subject to charges under the Bylaws of Local 802 and may be deemed to have given notice of his or her resignation from the American Federation of Musicians and any locals of the Federation to which he or she belongs.” Any member who violates Article IX, Subdivision #1, Section C of the Local 802 Bylaws shall be subject to penalties in accordance with Article 11, Section 13 of the Local 802 Bylaws.
