TUESDAY, AUGUST 16, 2016

Meeting called to order at 11:03 a.m. by President Gagliardi. Present: Financial Vice President Olcott, Executive Board members Cutler, Hyde, Kruvand, Sharman, Suttmann, Assistant to the President Bond. Sharman taking minutes. President Gagliardi gave the oath of office to Jay Brandford to fill a vacancy on the Executive Board. Minutes from August 9, 2016 reviewed. Executive Board member Burridge present at 11:06. It was moved and seconded to approve the minutes from August 9, 2016 as corrected. Discussion held. Motion carried unanimously.

Gagliardi presented a Memorandum of Agreement (MOA) between Local 802 and Radio City Productions, LLC. It was moved and seconded to recommend the MOA for ratification by the bargaining unit. Discussion held. Motion carried unanimously.

Gagliardi announced his participation on the Federal Mediation and Conciliation Service (FMCS) panel at the FMCS 2016 National Labor-Management Conference in Chicago August 17-19, 2016. Discussion held.

Financial Vice President Olcott reported that negotiations with the Orchestra of St. Luke’s and the American Symphony Orchestra at Bard College are nearing completion. Discussion held. Olcott reported on contract negotiations with the Bronx Arts Ensemble. Gagliardi distributed Findings of the Local 802 Trial Board. Discussion held.

Gagliardi presented a request to donate to the Council for Living Music an amount equivalent to the cost of a trio of musicians for the Tenants Political Action Committee (Tenants PAC) fundraising meeting on September 30, 2016. Motion made and seconded to donate the cost of a trio to the Council for Living Music for the Tenants PAC fundraiser. Discussion held. Motion carried unanimously.

Discussion held on Local 802 delegates to the New York State AFL-CIO constitutional convention to be held on August 22-23, 2016 at the Sheraton Times Square Hotel, New York. Local 802 voting delegates are Tom Olcott, Martha Hyde and Clint Sharman.

Gagliardi presented requests from five members for leaves of absence from Broadway shows. Motion made and seconded to approve the leaves of absence. Discussion held. Motion carried unanimously.

Principal business rep Sheldon present. Sheldon presented a Limited Pressing Agreement (LPA) with the production “Cagney.” Sheldon excused. Motion made and seconded to approve the LPA. Discussion held. Motion carried unanimously. Discussion held on the contractual requirements of recording Broadway cast albums.

Discussion held on The Orchestra Now, a training orchestra and master’s degree program of Bard College. Discussion held on Distinguished Concerts International New York (DCINY). Discussion held on Chicago The Musical: 20th Anniversary Concert to be held at Central Park SummerStage on August 31, 2016.

Communications and Political Director Carroll present via conference call at 12:24. Discussion resumed on Local 802 delegates to the New York State AFL-CIO constitutional convention. Carroll proposed a Local 802 political program initiative and a Tempo fundraiser. Discussion held. Carroll excused 12:39.

TUESDAY, AUGUST 30, 2016

Meeting called to order at 11:07 a.m. by President Gagliardi. Present: Financial Vice President Olcott, Recording Vice President Schwartz, Executive Board members Brandford, Cutler, Dougherty, Sharman, Suttmann. Minutes from August 16, 2016 reviewed. It was moved and seconded to approve the minutes from August 16, 2016 as corrected. Discussion held. Motion carried unanimously.

President Gagliardi reported that a memorial service will be held for Jay Fishman on September 23, 2016 and include a performance by members of the New York City Ballet. Gagliardi reported that Theatre Department Senior Business Rep Blum has resigned her position at Local 802 effective September 7, 2016. Gagliardi reported on his attendance at the Future@Work Labor-Management Conference, August 17-19, 2016, in Chicago, presented by the Federal Mediation and Conciliation Service and his participation in a panel discussion. Executive board member Kruvand present at 11:17. Gagliardi reported on his attendance at the ICSOM conference in Washington, D.C., August 23-27, 2016.

Financial Vice President Olcott presented a request for the use of public service scales from Orchestra of St. Luke’s for the 2016-17 season, including rehearsals and concerts for the Subway Series, with concerts scheduled for October 15, 16, 19, 22 and 23, 2016; the Fall Education series with concerts scheduled for November 29, 30, and December 1, 2016; the Holiday Sing with a concert scheduled for December 16, 2016; and the Spring Education series with concerts scheduled for May 17-19, 2017. It was moved and seconded to approve the use of public service scales for the rehearsals and concerts scheduled for the 2016-17 season of Orchestra of St. Luke’s as proposed. Discussion held. Motion carried unanimously.

Olcott presented a request for the use of public service scales from Bronx Arts Ensemble for concerts as scheduled on October 20, 2016; December 3-5, 11, 2016; February 9, 2017; April 1-2, 2017. It was moved and seconded to approve the request for the use of public service scales from the Bronx Arts Ensemble as proposed. Discussion held. Motion carried unanimously.

Olcott presented a Memorandum of Agreement between Local 802 and Orchestra of St. Luke’s. It was moved and seconded to approve the Memorandum of Agreement between Local 802 and Orchestra of St. Luke’s for ratification by the bargaining unit. Discussion held. Motion carried unanimously.

Recording Vice President Schwartz presented a Memorandum of Agreement to extend the collective bargaining agreement between Local 802 and the Big Apple Circus for the term of August 16, 2016 through August 15, 2017. It was moved and seconded to approve the Memorandum of Agreement as presented. Discussion held. Motion carried unanimously.

Schwartz reported on a meeting between Local 802 and representatives of Live Nation and the NYCB Theatre at Westbury to address a grievance filed by Local 802 regarding a performance by Tommy Tallarico and Video Games Live that took place on July 22, 2016. Schwartz reported on the status of negotiations between Local 802 and Avatar Recording Studios for a collective bargaining agreement to cover the studio assistants. Discussion held. Schwartz reported on the status of negotiations between Local 802 and Kaufman Center for a collective bargaining agreement to cover the teaching artists employed at the Center. Discussion held. Schwartz reported on the status of negotiations between Local 802 and Jazz at Lincoln Center for a successor collective bargaining agreement. Discussion held.

Schwartz presented requests from three members for leaves of absence from Broadway shows. It was moved and seconded to approve the requests for leaves of absence. Discussion held. Motion carried unanimously.

Political and Communications Director Carroll present. Carroll reported on the production of a postcard to be mailed in support of Micah Lasher, candidate for State Senator from New York District 31. Discussion held. Carroll reported on his participation in political canvassing with candidates Micah Lasher and Linda Rosenthal. Discussion held.

Carroll and Executive Board member Cutler presented a proposal from the Executive Board’s Web site Subcommittee regarding an update of the Local 802 Web site. Discussion held.

Carroll presented recommendations of the Executive Board Political Subcommittee for Local 802’s endorsement of candidates for office, including Brad Hoylman for State Senate from NY District 27, Michael Gianaris for State Senate from NY District 12, Linda Rosenthal for State Assembly from NY District 67, Carl Heastie for State Assembly from NY District 83, and Brian Kavanagh for State Assembly from NY District 74. Carroll excused.

Gagliardi requested that the Executive Board confirm the results of an email poll approving the creation and mailing of a postcard in support of the candidacy of Micah Lasher. It was moved and seconded to confirm the poll. Discussion held.  Motion carried unanimously.

Gagliardi requested that the Executive Board approve the recommendations of the Web site Subcommittee for the engagement of the firm Social Ink to update the Local 802 Web site, and the proposed budget of $10,000 with such funds to come from the Public Relations budget. It was moved and seconded to approve the engagement of Social Ink and the proposed budget. Discussion held. Motion carried unanimously.

Gagliardi requested that the Executive Board approve the recommendations of the Political Subcommittee for the endorsement of candidates by Local 802.  It was moved and seconded to approve the recommendations of the Political Subcommittee. Discussion held. Motion carried unanimously.

Board recessed at 11:55. Board reconvened at 12:05. Director of Organizing and Field Services Russell-Brown present. Russell-Brown presented a budget for the hiring of a band and a float for the 2016 Labor Day Parade as scheduled for September 10, 2016. Russell-Brown excused. Gagliardi requested that the Executive Board approve the budget for the Labor Day Parade band and float. It was moved and seconded to approve up to $6,000 for the Labor Day Parade. Discussion held. Motion carried unanimously.

Concert Department Senior Business Rep Marisa Friedman present. Friedman presented a request from the Senior Concert Orchestra of NY for the use of public service scales for rehearsals on September 16 and 19, 2016 in preparation for a concert at Stern Auditorium on September 21, 2016. Friedman excused. It was moved and seconded to approve the request from the Senior Concert Orchestra of NY for the use of public service scales as proposed. Discussion held. Motion carried unanimously.

Theatre Department Senior Business Rep Blum present. Blum presented a Memorandum of Agreement between Local 802 and On Q LLC to extend the agreement for the production of “Avenue Q” through August 15, 2017. It was moved and seconded to approve the Memorandum of Agreement between Local 802 and On Q LLC. Discussion held. Motion carried unanimously.

Gagliardi reported that an application for a Special Situation from Circle in the Square had been granted for the a cappella production of “In Transit.”  Discussion held.

Olcott announced that the agreement between Local 802 and Radio City Music Hall had been ratified by the bargaining unit. Discussion held.

TUESDAY, SEPTEMBER 6, 2016

Meeting called to order at 11:05 a.m. by President Gagliardi. Present: Financial Vice President Olcott, Recording Vice President Schwartz, Executive Board members Burridge, Dougherty, Hyde, Kruvand, Suttmann, Assistant to the President Bond, Political and Communications Director Carroll. Minutes from August 30, 2016 reviewed. Executive Board member Sharman present at 11:08. It was moved and seconded to approve the minutes from August 30, 2016 as corrected. Discussion held. Motion carried unanimously.

President Gagliardi and Assistant to the President Bond reported on Theatre Department personnel matters. Discussion held. Financial Vice President Olcott reported on a meeting with Bronx Arts Ensemble. Discussion held. Recording Vice President Schwartz announced December 14, 2016 for the Local 802 Holiday Party. Discussion held. Schwartz presented a request from a member for a leave of absence from a Broadway show. It was moved and seconded to approve the leave of absence. Discussion held. Motion carried unanimously.

Gagliardi and Political and Communications Director Carroll reported on a candidate screening meeting between members of the Executive Board and Adam Haber, candidate for NY State Senate from District 7 Nassau County. Discussion held.

Carroll proposed that Local 802 purchase tickets to a political event in support of Hillary Clinton for President on September 19, 2016. It was moved and seconded to purchase tickets in the amount of $500 to the Hillary Clinton for President event. Discussion held. Motion carried unanimously.

Bond reported on a proposed chamber music concert by musicians of the Metropolitan Opera to be scheduled in the spring of 2017 at the Manhattan VA Hospital. Discussion held.

Carroll discussed an amendment to Article 1, Section 5(n) of the Local 802 By-laws regarding limits on donations. Discussion held. Carroll excused.

Theatre Department Senior Business Rep Blum present. Blum presented a Memorandum of Agreement between Local 802 and A Dog Story The Musical LLC for a production of “A Dog Story: The Musical” to be presented at the Davenport Black Box Theatre. Blum excused. It was moved and seconded to approve the Memorandum of Agreement with A Dog Story The Musical LLC. Discussion held. Motion carried unanimously.
