Single Engagements, Hotels and Steadies

The function of this department is primarily negotiating, internal organizing and contract enforcement in the above areas of the industry. Business Representatives in this department handle contract negotiations, grievances (disputes) arising from contract violations and other workplace issues. Typical grievances include failure to pay wages, wage shortages, failure by an employer to make timely health and pension benefit payments, health and safety issues, and many others. Business Representatives in the department maintain a presence in many key New York City and Long Island venues to assist musicians with any problems that may arise between them and their employers. The department represents musicians who work under more than 50 collective bargaining agreements (CBAs) in the following areas of the music industry: single engagement club dates and other single engagements; Westbury Music Fair; Jones Beach; Gateway Playhouse; hotels; restaurants; night clubs and cabarets. The department also assists members in obtaining benefit contributions from nontraditional employers through the use of Music Services contracts.
Single Engagement Club Dates
Club dates are single engagements for weddings, bar/bat mitzvahs, corporate or "society" dinner-dances, benefit and awards dinners and other one-time engagements. Thousands of contracts employing hundreds of Local 802 members are filed in this field each year. Single engagement club dates account for most of the department's work. More than 40 club date employers are signatory to the Single Engagement Club Date Agreement, five more employers are signatory to the Jewish Club Date Agreement, and dozens of member/leaders file contracts for fellow members. All contracts are examined for errors by the Single Engagement Contract Administrator, Kimeo Lee. Grievances for wage, expense and benefit shortages are filed with employers in accordance with the agreement. In 1998, the department collected nearly $100,000 in wages and benefits as a result of such grievances.
Club Date Business Representatives are responsible for working closely with musicians in this field to insure compliance with the agreement. They make routine random visits to dozens of venues in Manhattan, Brooklyn, Queens and Long Island. All calls to Club Date Business Representatives to report engagements or grievances are held in the strictest confidence. Representatives also write and publish The Screamer, a quarterly newsletter for club date musicians.
Hotels and Other Steady Engagements
The collective bargaining agreement between Local 802 and signatory hotels representing the Hotelmen's Committee is a "master agreement" that forms the basis for many contracts covering musicians who perform on a steady basis in restaurants, night clubs, cabarets and other venues. Musicians who are engaged to perform on a steady basis by agents who act as musical directors for many major Manhattan hotels are covered under the same master agreement. The agreement has provisions for minimum scale wages, health and hospitalization coverage, pension, and other terms and conditions of employment.
Other steady engagements are covered by separately negotiated agreements, but often incorporate provisions similar to those in the Hotel Agreement. Department Business Representatives and the Supervisor are available to negotiate with employers over wage and benefit rates and working conditions on behalf of members.
Local 802 Musicians' Referral Service
The Referral Service is administered by the Contract Administration Department and is an important benefit of membership. The goal of the service is to help increase job opportunities for members and to promote Local 802 in the community. An increase in advertising in area "yellow pages" and membership in the New York Convention and Visitor's Bureau has resulted in a substantial increase in the number of calls coming into the service.
Although most referrals are for single engagements such as weddings and other private parties, the service has successfully placed musicians in steady engagements, recording sessions, cruise ship jobs, fashion shows, off-Broadway musicals and tours.
A growing data base of more than 200 musicians is maintained and all interested members are invited to sign up. The policy of the service is that all musicians obtaining jobs through a referral must be members in good standing and must file union contracts paying appropriate scale wages, health and pension benefits, and all premiums.
