BACK TO WAGE SCALES MENU

NATIONAL PUBLIC TELEVISION AGREEMENT SUMMARY
December 11, 2002 - December 10, 2005
Extended until further notice

For the rates provided in Table 1, producer is entitled to one (1) national release consisting of seven consecutive days. Producer may make unlimited use of the program during this release.

For the rates provided in Table 2, producer is entitled to four (4) national releases during the period of three years (five years if the program is a documentary), consisting of seven consecutive days for each release. Producer may make unlimited use of the program during each individual release. Furthermore, producer has the option of paying an additional 50% at the time of original employment, entitling producer to two (2) additional releases and extending the exhibition period by two years or the option of electing a first release period of (14) consecutive days by paying 15% extra at the time of the original employment. With respect to pledge programs, producer may elect a release pattern of eight (8) releases over 25 months or four (4) releases over three (3) years (5 years if the program is a documentary).

Non Variety Programs With respect to episodic, dramatic, non-dramatic & documentary series or programs, Producer may elect to utilize the terms and conditions of the Television Film Agreement.

Music Preparation: Arrangers scale is negotiable, but may not be less than Orchestrator scale. Copyist's scale is negotiable, but may not be less than Music Preparation rates. Invoices must be filled out, and all Music Preparation wages should go on the performance report contract form. Otherwise, it will be difficult to collect benefits and residual payments.

Reuses: 100% of total scale, including rehearsal. If paid for under Table 2. (If paid under Table 1, the upgrade payment is applicable, (for 1 re-use only)). Pension 10% (No health benefits payment on reuses.)

Internet Streaming:
In addition to the rights associated with Table 2 payments, Producer shall also have the right to use a program or any portion thereof on Producer's website as well as PBS and related websites and on-line services during the related Table 2 cycle provided that such websites and/or on-line services do not assess a charge to the consumer for downloading such programs.

In the event downloading charges are assessed, producer will not notify the AFM and negotiate a new provision concerning such downloading. Symphony, Opera & Ballet programs are excluded from this provision.

Direct Broadcast Satellite (DBS) :
Producer shall have the right to release any programs produced under this or any previous PBS agreement for Direct Satellite Broadcast as commonly understood in the Industry in perpetuity provided the musicians were paid initially the following minimums:

  • 1/2 hr program - program rate plus one hour rehearsal
  • 1 hr program - program rate + 2 hrs rehearsal
  • 1 1/2 hr program or longer - program rate + 3 hrs rehearsal

In the event, these programs were not paid for at the foregoing minimums. producer shall have the right to release these programs in perpetuity by paying each musician whose music is included in these programs at the rate of $7.50. Symphony, Opera, & Ballet programs are excluded from this provision.

DTV:
Producer shall have the right to broadcast digital television programs which have been produced under this agreement or any previous PBS agreement on a multicasting basis on digital bands divided into four (4) separate signals and may also release such programs on digital cable in exchange for payment of the initial minimum compensation. This provision will be in effect for at least 18 months commencing December 11, 2002.

Foreign Use
Producer may broadcast programs on an unlimited basis outside of the U.S. and Canada by paying 45% of the original total wage scale payments (including air time plus all rehearsal hrs).
