Tuesday April 2, 2013

Meeting called to order at 11:07 AM by Financial Vice President Olcott. Present: Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Cranshaw, Cutler, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Boyle.

It was moved and seconded to approve the minutes from March 26, 2013 as corrected. Motion carried unanimously.

Assistant to President Boyle reported on plans for the Recording Musicians Association of New York (RMA-NY) to use the Local 802 Clubroom for a “mixer” later this month. Discussion held.

Financial Vice President Olcott requested annual salary adjustments for two Local 802 non-bargaining unit employees. It was moved and seconded to grant the request. Motion carried unanimously.

Olcott reported on Westchester Philharmonic payment to musicians. Discussion held.

Recording Vice President O’Connor reported on collection efforts from Local 802 members delinquent in payment of work dues.

O’Connor reported on a request from New Yorkers Against Fracking for Local 802 to join their coalition. Discussion held.

O’Connor reported on a vacancy on the sixth floor of the Local 802 building.

Executive Board Member Dougherty presented a proposal for a presentation at a Local 802 membership meeting by Cornell School of Labor Relations. Discussion held on ideas for presentations at Local 802 membership meetings.

Local 802 Concert Representative Fisher present. Fisher presented a request from the Knickerbocker Chamber Orchestra to use public service scales for a children’s school concert on April 8. Discussion held. Fisher excused. It was moved and seconded to approve the request from the Knickerbocker Chamber Orchestra. Motion carried unanimously.

Labor Press editor and publisher Neal Tepel present. Tepel gave a presentation on Labor Press, a union news magazine. Discussion held. Tepel excused.

Electronic Media Services Department Representative Sheldon present. Sheldon presented a Limited Pressing Agreement (LPA) with PS Classics for the production of “Passion.” President Gagliardi present. Gagliardi assumed the chair. Discussion held. Sheldon excused. It was moved and seconded to approve the LPA for “Passion.” Motion carried unanimously.

Gagliardi reported on upcoming New York Philharmonic negotiations. Gagliardi reported on preparations for New York City Ballet negotiations. Discussion held.

Gagliardi made note of an event called Eric Clapton’s Crossroads Guitar Festival scheduled for April 12 at Madison Square Garden. Discussion held.

Gagliardi reported on the musical, “King Kong,” coming to Broadway. Discussion held.

Gagliardi reported on the Baz Luhrman production of Rite of Spring coming to City Center using recorded tracks. Discussion held.

Gagliardi appointed Executive Board members Kruvand and Schwartz to the Electronic Media Services Department Oversight Committee. Discussion held.

Meeting called to order at 11:08 AM. Present: President Gagliardi, Financial Vice President Olcott, Recording Vice President O’Connor, Executive Board members Brandford, Burridge, Cranshaw, Cutler, Dougherty, Hyde, Schwartz, Sharman, Assistant to the President Boyle.

Minutes from April 2, 2013 reviewed. Executive Board Member Burridge excused at 11:13. It was moved and seconded to approve the minutes from April 2, 2013 as corrected. Motion carried unanimously. Burridge present at 11:16.

Discussion held on Eric Clapton’s Crossroads Guitar Festival coming to Madison Square Garden April 12 and 13.

President Gagliardi reported that the Limited Pressing sessions for the Off Broadway musical “Passion” had to be postponed because a featured actor fell ill. Discussion held. Gagliardi presented a “postponement of recording sessions” agreement for the above sessions. It was moved and seconded to approve the “postponement of recording sessions” agreement. Discussion held. Motion carried unanimously.

Gagliardi presented an excerpt of the documentary film “The Girls in the Band.” Discussion held. Gagliardi read a letter from the producers of The Girls in the Band requesting that Local 802 become a sponsor of a screening of the film. Discussion held. It was moved and seconded to become a sponsor of the film for $3,000 to be paid from the public relations budget.

Gagliardi reported on New York City Ballet negotiation matters. Discussion held.

Gagliardi reported on an Inside Broadway educational program scheduled at the Palace Theatre on April 11. Discussion held.

Gagliardi reported on the upcoming joint New York/New England AFM Conference of Musicians.

Gagliardi reported that charges brought under AFM Bylaws against certain officers and past officers of Local 802 by Gary Pace and Quentin Solano, President and Secretary respectively of AFM Local 38-398, Larchmont, NY have been dismissed (see minutes from 1/22/13). Discussion held.

Financial Vice President Olcott reported on Westchester Philharmonic payments to musicians.

Discussion held on finance subcommittee matters.

Recording Vice President O’Connor reported on Justice for Jazz Artists marches and demonstrations scheduled for April 11, using the slogan, “Jazz Built This.” Discussion held.

O’Connor reported on organizing activities in the Club Date field, specifically in regard to the nonunion club date office, Faze 4. Discussion held.

Assistant to the President Boyle gave a presentation on John Duane, who is running for City Council district 19. Discussion held.

Assistant to the President Boyle gave a presentation on Antonio Reynoso, who is running for City Council district 34. Discussion held.

It was moved and seconded to endorse Duane and Reynoso. Discussion held. Motion carried unanimously.

Boyle presented an invitation to a fundraiser for Attorney General Eric Schneiderman. It was moved and seconded to purchase two tickets to the Schneiderman fundraiser on May 21 for a total of $500 to be paid from the TEMPO account. Discussion held. Motion carried unanimously.

Discussion held on Local 802’s strategic use of political endorsements.

Gagliardi announced a meeting with composers on post production tax credits scheduled for April 10. Discussion held.

Discussion held on possible renovations to the club room.

Minutes from April 9, 2013 reviewed. It was moved and seconded to approve the minutes from April 9, 2013 as corrected. Motion carried unanimously.

President Gagliardi reported on New York City Ballet committee elections.

Gagliardi reported on a Broadway leave of absence inquiry. Discussion held.

Gagliardi reported on a contract issue with a copyist doing work on a production in the jurisdiction of AFM Local 16. Discussion held.

Gagliardi reported on the AFM New York/New England joint conference held in Enfield, CT on the weekend of April 12. Discussion held.

Financial Vice President Olcott reported on an initiative to find funding for dance companies to enable them to hire live music. Discussion held.

Olcott reported on Westfield Symphony negotiations. Discussion held.

Recording Vice President O’Connor reported on an attempt by workers at the Guitar Center to organize a union and a request from the Retail, Wholesale and Department Store Union to lend support to the campaign. Discussion held. It was moved and seconded to support the Guitar Center workers’ efforts to unionize. Discussion held. Motion carried unanimously.

Local 802 Central Labor Council Delegate Marvin Moschel present. Moschel gave a delegate’s report from the March 21 Central Labor Council meeting. Discussion held. Moschel excused.

Discussion held on the planned New York City May Day march. Theatre Representative Couture present. Couture presented a memorandum of agreement (MOA) with Starcatcher NWS LP for Off Broadway production of “Peter and the Starcatcher.” Discussion held. Couture presented a collective bargaining agreement (CBA) with Brooklyn Academy of Music (BAM)for the production of “Master Builder.” Discussion held. Discussion held on rules in Local 802’s bylaws regarding Broadway leaves of absence. Couture excused.

O’Connor presented a request for a leave of absence from a Broadway musician. It was moved and seconded to approve the leave of absence.

It was moved and seconded to approve the CBA with BAM. Motion carried unanimously.

It was moved and seconded to approve the MOA with Starcatcher NWS LP. Motion carried unanimously.

Discussion held on offering a program of interest to members at the June 12 membership meeting.

Minutes from April 16, 2013 reviewed. It was moved and seconded to approve the minutes from April 16, 2013 as corrected. Motion carried unanimously.

Assistant to the President Boyle reported on New York City Public Advocate and Mayoral candidate Bill de Blasio’s response to a Local 802 political endorsement questionnaire in advance of today’s scheduled visit with the Local 802 Executive Board. Boyle excused. President Gagliardi reported on Broadway matters.

Boyle and New York City Public Advocate de Blasio present. Discussion held. De Blasio excused.

Financial Vice President Olcott reported on a request from the Queens Symphony to use public service scales for concerts on May 8 and 10 in the event that the Music Performance Trust Fund (MPTF) does not grant its application. It was moved and seconded to grant the request. Motion carried unanimously.

Gagliardi appointed Local 802 members Bettina Covo, Miho Matsuno, Bill Rohdin and Executive Board members Cranshaw and Sharman to the Anne Walker Scholarship Fund panel.

Discussion held on de Blasio visit.

Electronic Media Services Department Representative Sheldon present. Sheldon reported on an event sponsored by Local 802 and the Society of Composers and Lyricists scheduled for April 30 in the Local 802 club room. Discussion held. Sheldon excused. Recording Vice President O’Connor present at 1:20. It was moved and seconded to approve up to $350 for refreshments for the April 30 event. Discussion held. It was moved and seconded to table the motion. Discussion held. Motion carried unanimously. Boyle and Olcott excused at 1:28.

O’Connor presented 8 requests for leaves of absence from Broadway musicians. It was moved and seconded to approve the leaves of absence. Motion carried unanimously.

Local 802 Controller Camiolo present. Camiolo presented January financials, consolidated financial statements for 2011 and 2012 and the 2013 budget. Discussion held. Camiolo excused. It was moved and seconded to approve the 2013 budget. Motion carried unanimously. Executive Board members Cutler and Hyde excused at 2:06.

O’Connor reported on 54 Below’s refusal to bargain with Local 802. Discussion held.

O’Connor requested approval of up to $2,500 so that the Council for Living Music could hire musicians for the May Day march. Discussion held. It was moved and seconded to donate the equivalent of the cost of a twelve piece band to the Council for Living Music up to $2,500, to come from the public relations budget. Motion carried unanimously.

O’Connor reported on a fundraiser for New York State Senator John DeFrancisco. Discussion held.

Discussion held on TEMPO, Local 802’s political action committee (PAC).

Discussion held on the special situations clause of the Broadway Agreement.

Minutes from April 23, 2013 reviewed. It was moved and seconded to approve the minutes from April 23, 2013 as corrected. Motion carried unanimously.

President Gagliardi reported on the appointment of Music Performance Trust Fund (MPTF) trustee, Daniel Beck. Discussion held.

Gagliardi reported on a Metropolitan Opera Orchestra Associates meeting. Discussion held.

Gagliardi reported on a meeting of the New York Philharmonic committee.

Gagliardi reported on auditions for “Richard III” and “Twelfth Night,” scheduled to open on Broadway.

Assistant to the President Boyle excused. Financial Vice President Olcott reported on a meeting with various interested parties to proceed with an effort to raise funds to provide live music for dance ensemble performances. Discussion held.

Recording Vice President O’Connor reported on his attendance at the Actors Fund Gala. Discussion held.

O’Connor presented an invitation to the Working Theatre 2013 Annual Awards Ceremony. It was moved and seconded to purchase a half page ad in the Working Theatre Annual Awards Ceremony program for $350. Motion carried unanimously.

O’Connor presented an invoice for $20,576 from Geto&de Milly for the purchase of numerous ads as part of the jazz nightclub campaign, to be paid from the public relations budget. Discussion held. It was moved and seconded to pay the invoice. Motion carried unanimously.

O’Connor reported on the nightclub 54 Below’s refusal to bargain with Local 802. Discussion held. It was moved and seconded to put 54 Below on Local 802’s Unfair List beginning May 8. Discussion held. Motion carried. Hyde opposed.

Boyle and mayoral candidate Bill Thompson present. Thompson gave a presentation on his bid for Mayor of New York City. Discussion held. Executive Board member Hyde excused. Thompson excused.

Executive Board recessed at 12:55. Executive Board reconvened at 1:08.

O’Connor reported on a meeting between composer/orchestra leaders and Local 802 officers on April 26 to discuss subjects of mutual interest. Discussion held.

O’Connor reported on new city restrictions for street musicians. Discussion held.

Boyle reported that the Speaker of the City Council has adjusted the language in new city sick-leave legislation to clarify the inclusion of musicians and other performing artists as employees in respect to this legislation. Discussion held.

Discussion held on Bill Thompson’s visit with the Executive Board.

O’Connor presented a request for a leave of absence from a Broadway musician. It was moved and seconded to approve the leave of absence. Motion carried unanimously.

Concert Representative Fisher present. Fisher presented a request from Sylvan Winds to use public service scales for performances on May 9 and 12 in the event that the MPTF does not grant its application for funds. Discussion held. Fisher presented a request from New York Grand Opera to use public service scales for performances on May 29 and July 12 in the event that the MPTF does not grant its application for funds. Fisher presented a request from Knickerbocker Chamber Orchestra to use public service scales for performances on May 8 and 9 in the event that the MPTF does not grant its application for funds. Fisher presented requests from North/South Consonance to use public service scales for performances on May 4, May 5, June 5, June 6, June 17 and June 18 in the event that the MPTF does not grant its application for funds for one or more of the above performances. Fisher excused.

It was moved and seconded to grant the above requests presented by Fisher.

Executive Board member and Emergency Relief Fund fundraiser Schwartz announced the appointment by the Actor’s Fund of Siena Shundi as the new Musicians Assistance Program social worker.
