Trial Board Report

Meeting called to order at 1 p.m. Present were members Goletz, Hood, Koch, Lambert, Ray, Roberts, Schwartz (Trial Board clerk) and Singer. Member Rojas absent.

Case #925: Plaintiff Erwin L. Price, Recording Vice-President, Local 802, appeared before the Board to present charges and testimony against member Jordan A. Hirsch. Member Hirsch failed to appear before the Trial Board as ordered.

The defendant was charged with violating Local 802 bylaws: Article III, Section 5, Paragraph (d) relating to the member’s failure to pay work dues and Article IV, Section 1, Paragraphs (g), (aa), (qq), relating to the member’s failure to properly file a contract with the Recording Vice-President’s office and failure to file a contract upon receipt of a deposit for an engagement.

The Trial Board found and concluded (by a vote of 8-0) that the defendant had violated Article III, Section 5, Paragraph (d) and Article IV, Section 1, Paragraphs (g), (aa). It was determined that Article IV, Section 1, Paragraph (qq) was not applicable and so dismissed.

The defendant was ordered to pay a fine of $100 for failing to appear before the Trial Board, and further ordered to pay work dues in the amount of $1,087.79 no later than Jan. 2, 2003. Failure to remit such dues will result in the termination of membership and notification of such termination being sent to all signatory employers informing them that they may no longer utilize the member’s professional services. Additionally, Member Hirsch was ordered to pay late fees in the amount of $1,506.96.

Case #926: Plaintiff William Moriarity, President, Local 802, appeared before the Board to present charges and testimony against defendant James B. Harp. Member Harp failed to appear before the Trial Board as ordered.

Member Harp was charged with violating Article XXI, Section 4 of the bylaws of the American Federation of Musicians, relating to the member’s activities as an officer of a company engaged in the creation of musical accompaniment for live performances which would be used to replace live musicians in the event of a labor dispute.

The Trial Board fined Member Harp $100 for failure to appear as ordered. The board’s decision as to the charges will be held in abeyance pending future action by Local 802.
